This document governs the terms of voluntary financial support of the creative project KOVΔ via the website kova.art (hereinafter — the "Website"). By making a payment, the Payer confirms that they have read, understood, and accepted these Terms and the Refund Policy.
Information about the Website Administrator, who is the recipient of the funds, is set out in the "Contacts" section.
1. What is offered
On the Website, you may voluntarily support the creative project KOVΔ in two formats:
- One-time donation ("Throw on more wood") — a single payment at the levels of "Kindling" (UAH 111), "Splinter" (UAH 333), "Log" (UAH 777), "Block" (UAH 1111), "Oak" (UAH 3333), or any custom amount in hryvnia.
- Monthly donation ("Keep the fire going") — the same voluntary contribution that recurs automatically in the same amount each month, until the Payer decides to stop it (see Section 4 for details).
A voluntary donation is not payment for an individual service, course, consultation, or physical product, unless explicitly stated otherwise on the relevant page of the Website. The publicly available materials of the project (texts, videos, social media publications) remain freely accessible.
By making a payment, the Payer confirms that:
- the amount is financially acceptable to them;
- the funds belong to the Payer, and the use of the payment instrument is authorised by its holder;
- they have read the Refund Policy and accepted these Terms.
2. Payment process
- On the "Throw on more wood" page, the Payer selects a level or enters a custom amount.
- The Payer presses the "Throw on more wood" button (one-time donation) or the "Keep the fire going" button (monthly donation). Pressing the button constitutes acceptance of these Terms and of the Refund Policy.
- The Website redirects the Payer to the secure page of the WayForPay payment processor, where the Payer chooses a payment method and confirms the payment.
- Following a successful charge, the Payer is returned to the Website, and an electronic receipt with an order number (in the format
KOVA-XXXXXXXXXX-XXXXXX) is sent to the email address provided.
The electronic receipt is sent within 15 minutes after a successful charge. In the case of a monthly donation, a receipt is sent for each new charge.
3. Payment methods
Payments are processed exclusively through the WayForPay payment processor (LLC "Wayforpay Ukraine", USREOU code 36584549). Available methods:
- Visa and Mastercard bank cards (domestic and international);
- the national payment system "Prostir";
- Apple Pay — in Safari on iPhone, iPad, and Mac with Touch ID or Face ID;
- Google Pay — in Chrome on Android and desktop;
- Privat24 — transfer from a PrivatBank customer account;
- QR-code payment from a mobile banking app.
For monthly donations, only methods that support card-token storage are used (Visa, Mastercard, "Prostir"). Apple Pay, Google Pay, and Privat24 may be used for the first payment — subsequent recurring charges are processed against the card linked to the relevant wallet.
All payments are made in hryvnia (UAH). If the Payer's card is denominated in another currency, conversion is performed by the issuing bank at its own rate. The Website Administrator does not collect any additional fees from the Payer; the fee of the payment processor is borne by the Website Administrator.
The Website does not store the full card number, the CVV/CVC code, or the expiry date. These details are entered directly on the WayForPay page, which is certified to PCI DSS Level 1. The Website handles only the masked number (last four digits) for record-keeping and dispute resolution.
4. Monthly donation
The "Keep the fire going" button sets up a recurring monthly charge in the same amount. Pressing the button and the successful confirmation of the first payment on the WayForPay side constitute the Payer's express and informed consent to:
- the storage by the WayForPay payment processor of a token of the bank card for subsequent recurring charges (the card itself is not stored by the Website Administrator);
- the automatic monthly charge of the chosen amount without the need to re-enter card details or pass 3-D Secure each time;
- the sending of an electronic receipt for each successful charge.
Charge parameters:
- Amount — the same amount the Payer selected when setting up the monthly donation (for example, UAH 333/month).
- Frequency — once per calendar month.
- First charge — at the moment of setup (upon confirmation by the issuing bank).
- Subsequent charges — on the date corresponding to the first-charge date in the previous month; if such a date does not exist in the current month (for example, the 31st in February), the charge is made on the last day of the month.
- Duration — until cancelled by the Payer or terminated for technical reasons (see below).
Termination of the monthly donation. The Payer has the right to terminate the monthly donation at any time, without giving reasons and without any penalty. It is sufficient to send an email with the subject line "Terminate monthly donation" to hello@kova.art or refund@kova.art from the email address that receives the receipts, indicating the order number of any of the executed payments.
- The Website Administrator deactivates the monthly donation on the WayForPay side within 1 business day of receiving the request.
- Confirmation of the termination is sent in reply to the Payer's email.
- If a regular charge has occurred before the request was processed, the funds are refunded in accordance with the Refund Policy.
- Previous successful charges, made during the period in which the monthly donation was active with the Payer's consent, are non-refundable, except in cases of malfunction of the Website or the payment processor.
Changing parameters of the monthly donation. The Website Administrator does not unilaterally change the amount, frequency, or other parameters of an already-established monthly donation. Any change (for example, a new contribution amount) is implemented as the termination of the current monthly donation and the voluntary set-up of a new one by the Payer.
Technical termination. The monthly donation is automatically terminated or suspended if:
- a regular charge has been declined by the issuing bank after several failed attempts in accordance with the policy of the WayForPay payment processor (insufficient funds, expired card, blocked card);
- the Payer has independently blocked the card or revoked the mandate at their bank;
- WayForPay or the acquiring bank has suspended processing for technical or regulatory reasons;
- the Website Administrator ceases accepting donations (with a notice to Payers via email at least 7 calendar days in advance).
5. Geography
Donations may be made from any country whose card or payment service supports transfers in hryvnia to a Ukrainian acquirer. The donation is provided in a fully electronic (remote) format: the Website does not ship any physical goods. Postal services (Ukrposhta, Nova Poshta, Meest, DHL, etc.) and couriers are not used.
Payments are not accepted from countries on which Ukraine or the international community has imposed sanctions prohibiting payments in hryvnia or with a Ukrainian acquirer — in particular, from the Russian Federation and the Republic of Belarus. For certain countries, a payment may be declined at the level of the issuing bank or the acquirer; in such cases, the Payer is returned to the Website with the status "The fire did not catch" and may retry the attempt or contact the Website Administrator.
6. Cancellation and refunds
The conditions for terminating a monthly donation and refunding funds are set out in detail in the Refund Policy. In short:
- One-time donations — non-refundable, except in cases of technical error, double charge, or fraudulent use of the card.
- Monthly donations — terminated upon the Payer's request by email to refund@kova.art. The most recent monthly charge may be refunded if the request is made within 14 days of its date; charges made in earlier months are not refundable — only further charges are stopped.
7. Personal data protection
The Website processes the Payer's personal data (name, email, payment data) solely for the purpose of executing the payment and fulfilling obligations under these Terms and under the laws of Ukraine. The data are not transferred to third parties, except to the WayForPay payment processor (for the purpose of executing payments) and in cases provided for by law. Bank-card data are not stored on the Website's side.
The Payer has the right to request, update, or delete their data by sending an email to hello@kova.art. The processing of personal data is carried out in accordance with the Law of Ukraine "On the Protection of Personal Data".
8. Rights and obligations of the Payer
- to provide accurate contact details (email, name) when paying;
- to check the "Spam" folder if the receipt email has not arrived within 15 minutes;
- to pay only with a card that belongs to the Payer or that the Payer is authorised to use by its holder;
- to terminate the monthly donation in good time if the Payer no longer wishes to continue it;
- to contact the Website Administrator through the channels indicated in the "Contacts" section regarding any matters concerning payments, monthly donations, or refunds.
A response to a request is provided within 3 business days; refund requests are processed within the time limits set out in the Refund Policy.
9. Limitation of liability
The Website makes reasonable efforts to ensure stable operation of the payment form but does not guarantee, and is not liable for:
- temporary unavailability of the Website or the payment processor for reasons beyond its control (hosting, internet provider, DDoS, force majeure);
- refusals by the issuing bank to authorise a payment or to confirm a regular charge under a monthly donation;
- errors made by the Payer when entering the email address or other data, as a result of which the receipt email did not arrive;
- actions of third parties who have obtained unauthorised access to the Payer's card or email account.
The maximum monetary liability of the Website Administrator under any claim shall not exceed the amount actually received from the Payer in respect of the relevant order.
10. Amendments to these Terms
The Website Administrator has the right to update these Terms unilaterally by publishing a new version on the Website. The new version takes effect from the moment it is posted and applies to payments made after that moment. Changes apply to an active monthly donation only after the Payer has been notified by email.
The Payer is required to review the current version of these Terms before each payment.

12. Governing law
The relations between the Website Administrator and the Payer are governed by the laws of Ukraine, in particular the Civil Code of Ukraine, the Law of Ukraine "On the Protection of Consumer Rights", the Law of Ukraine "On Electronic Commerce", the Law of Ukraine "On Payment Services", and the Law of Ukraine "On the Protection of Personal Data".
